Episode #108
Class #9: Association Records, Transparency & Disclosures in the Digital Age
Welcome to Class #9 of our 2026 Virtual HOA/Condo Academy - in partnership with the cities of Avondale, Chandler, Glendale, Goodyear, Mesa, Peoria, Phoenix, Scottsdale, Surprise and Tempe. My name is Beth Mulcahy and I am the founder and senior partner for the Mulcahy Law Firm in Phoenix, Arizona. Our firm currently represents more than 1,000 planned communities and condominium associations throughout Arizona. I also serve on my own board and have done so for many years, so I understand many of these issues from both the legal and board-member perspectives. Before we begin, I also want to share an exciting firm milestone: we are less than two months away from celebrating Mulcahy Law Firm’s 30th anniversary on November 1. We are incredibly grateful to the communities, board members, managers, city partners, and colleagues who have trusted us and supported our work over the years. Today, we’ll begin with a brief review of the new Arizona laws that took effect over the weekend, on September 12, and that affect HOAs and condominium associations. Then, we’ll move into today’s main presentation: Association Records, Transparency, and Disclosures in the Digital Age. In this session, you’ll learn: ● Which association records must be maintained, and how long they must be kept. ● How to respond to homeowner records requests, including which records may lawfully be withheld. ● How to protect confidential information while still meeting the association’s transparency obligations. ● Disclosure requirements. ● Transfer fees and capital-contribution fees. ● Common mistakes that can create unnecessary liability for an association Video of this class: https://youtu.be/SdLuWUTjslY and Q&A portion here: https://youtu.be/e7LUC-YFgGY Links and Cheat Sheets in this class: 2026 Legislation Summary: https://www.mulcahylawfirm.com/2026-pending-legislation-summary/ AZNH v.
