What Blockchain Gets Wrong About Asset Protection — Ted Sutton
Controlling a private key is not the same as legally protecting what's behind it. When a court order, civil judgement, or cross-border dispute enters the picture, blockchain doesn't have a legal system to fall back on. Jurisdictions do. In this episode, Collins Victory Odabi sits down with Ted Sutton to examine the gap between crypto's promise of sovereign ownership and the legal infrastructure that actually determines how assets are protected and enforced when it counts. What You'll Learn Controlling an asset and legally owning it are two separate things. "Not your keys, not your coins" describes technical access — not legal title. If digital assets are held in your individual name, a court can still reach them regardless of what blockchain they sit on. A Wyoming LLC is the most practical starting point for crypto asset protection. Low setup cost, no public disclosure of members, and charging order protection — meaning creditors can only lien distributions from the LLC, which you control. Most states don't offer this. Legal systems will always have jurisdiction over Web3. Decentralisation doesn't create a parallel judicial system. The idea that crypto exists outside the law's reach is a fundamental misreading of how enforcement actually works. AI in legal practice is a net negative right now. Attorneys have filed court documents citing fabricated case law from ChatGPT. AI cannot exercise professional judgement and is not a substitute for qualified legal counsel. Building wealth and protecting wealth are different disciplines. Asset protection is the foundation, not a reward for accumulating enough. The correct sequence is entity first, accumulation second.
